Terms & Conditions of Sale and/or Service 

 

Definition and Scope - Concrete Resurfacing & Epoxy Flooring
 

  1. These Terms apply whenever Goods or Services are quoted for, sold, supplied, delivered and installed by Superior concrete Solutions to a Customer.

  2. “Customer" means the customer placing an order and any agent or representative of that customer.

 

 

Acceptance

  1. Requesting or accepting a Quotation, placing an Order with or accepting a supply or Delivery of Goods or Services from Superior Concrete Solutions by a Customer constitutes acceptance by the Customer of these Terms and Conditions.

  2. Placement of an order by the Customer, either verbally or in writing, with the Supplier will constitute acceptance of the Supplier’s offer and of these terms and conditions.

  3. To the extent permitted by Law, it is a condition of the Quotation, sale, supply and Delivery of Goods and Services by Superior Concrete Solutions to a Customer that the Customer accepts that these Terms apply as provided in Clause 3, regardless of the provisions of any other document or instruction or/ and of oral understanding between the Customer, including any purchase order terms subsequently given to by Superior Concrete Solutions to the Customer
     

Standard terms and conditions of sale

  1. Any quotation or price information made available by Superior Concrete Solutions is without obligation and subject to change without notice unless an offer has been designated as binding.

  2. As permitted by law, Superior Concrete Solutions reserves the right to correct errors in its offers, invoices, and communications such as spelling or arithmetical errors.

  3. The Customer agrees that Superior Concrete Solutions may amend these terms and conditions at any time. If Superior Concrete Solutions makes a change to these terms and conditions, then that change will take effect from the date on which Superior Concrete Solutions notifies the Customer of such change. The Customer will be taken to have accepted such changes if the Customer makes contact with Superior Concrete Solutions to provide services including but not limited to Materials/Equipment/ installation.

  4. Any time or date of delivery or installation that has been provided by Superior Concrete Solutions to the Customer is an estimate only. The Customer must still accept delivery of the Materials/Equipment/Installation even if late and Superior Concrete Solution will not be liable for any loss or damage incurred by the Customer as a result of the delivery being late.

  5. Superior Concrete Solution reserves the right to refuse work or cancel pending work under this clause, Superior Concrete Solutions may refund deposit only if the customer had no fault/ blame or negligence in the cancelation of the work.

  6. Only with the exception of Clause 10, All deposits paid to Superior Concrete Solutions are non-refundable.

  7. If Superior Concrete Solutions is not satisfied as to the Customer's ability to pay for the Goods and/or services, it may suspend or terminate supply and shall not be liable for any claim, damage, loss, expense or cost arising therefrom and all monies then outstanding by the Customer shall immediately become due and payable.

  8. For any goods ordered and later cancelled the Customer shall pay the Superior Concrete Solutions all expenses incurred up to the time of cancellation. The statement of expenses shall be final and binding on the customer.

  9. The Customer acknowledges that in the event of cancelation of the job, the statement of expense will include a 30 percent fee of the total estimate of the work.

  10. The customer undertakes to pay for any additional material used in the process of providing the service by Superior Concrete Solutions.

  11. The Customer is responsible for providing suitable, clear, free and safe access for Superior Concrete Solutions delivery vehicle and Company agents and contractors at all times to enable them to undertake their work. In addition, the Customer agrees to indemnify the Company and its agents and contractors for all damage and injury to any person and to any public or private property, which may result, including any costs associated with enabling the delivery vehicle to leave the site, and the cost of any returned product as a result of the Customer failing to provide suitable and safe access to the delivery site.

  12. Superior Concrete Solutions shall not be liable for any loss or damage to the site, including without limitation, damage to pathways, driveways and concrete or paved or grassed areas.

  13. The customer agrees to indemnify the Superior Concrete Solutions against any liability Superior Concrete Solutions may incur as a result of the failure of the customer to follow generally accepted good practice, or due to a lack of ability, expertise, or skill with the particular type of goods when they are being installed.

  14. The customer is solely responsible to provide an uninterpreted supply of water and power for Superior Concrete Solutions at all times to enable them to undertake their work. In addition to bearing cost of the uninterpreted water and power supply the Customer agrees to indemnify the Company and its agents and contractors for all damage and injury to any person and to any public or private property, which may result due to the water or power supply provided and also in the event of Customer failing to provide suitable and safe access to power and water.  

  15. The Customer undertakes to pay half the payment on the first day of preparation of the work to be undertaken.

  16. Failure to provide half the payment on the first day may include consequence but not limited to the stated consequence, such as an extension of the completion/ delivery date or cancelation of the work by for Superior Concrete Solutions. Superior Concrete Solutions is not to be liable for any claim, damage, loss, expense or cost arising therefrom and all monies then outstanding by the Customer shall immediately become due and payable

  17. The Customer acknowledges that variations of colour and texture are inherent in concrete.

  18. The Superior Concrete Solutions shall not be liable for any loss, damages or costs howsoever arising resulting from any variation of the colour, or and, texture or and pattern between different batches of product and shall not be liable in any circumstances for any Loss arising from any alleged defect, non-conformity or failure in any concrete

  19. The Customer acknowledges that the concrete surface is fresh and soft till 35 days after completion of work. Therefore, Superior Concrete Solutions will not be liable for any damage done during the initial 35 days of completion of work.

  20. Superior Concrete Solutions will not be liable for any damage if it is the result of the effect of any weather conditions or temperature including but not limited to heat, cold, rain, wind or hail; or and by any act or omission, including but not limited to construction or site practices, of the Customer or a third party.

  21. Superior Concrete Solutions provides a 15 year warranty for peeling, when white patches appear on the concrete or the colour of the concrete fades away, and or, for chipping, that has occurred naturally, and or for surface cracking only.

  22. The 15 years warranty is not a blanket warranty or guarantee. It is subject to the condition that the concrete area is sealed by us, and that Superior Concrete Solutions has inspected the concrete and signed the original invoice or confirmed via email - The re-seal has to be within the recommended time frame. Depending on what service has been done it can be from 18 months -3 years from the date of installation/ delivery till the expiry of the 15 years. Our 15 year warranty does not cover cracks, salt effected areas or dampness.

  23. Superior Concrete Solutions will not be liable for the acts of 3rd Party, that was either, party or partially involved in the process of installation, or and, delivery, or and, repair, or and, providing of services. The customer further acknowledges that the warranty or guarantee provided by the Superior Concrete Solutions will be null and void in the above stated incidents.  

  24. The customer undertakes to pay a flat fee of $110 for call outs for repairs after the job has been completed.

  25. If the repair cost exceeds $100 a new separate quote will be issued and the repair will be treated a new job.
